Terms of Service

You must be at least 18 years old and able to form a binding contract to use the Services or buy from us. We currently offer the Services in the United States.

Novuspan products are dietary supplements. Statements about them have not been evaluated by the Food and Drug Administration, and they are not intended to diagnose, treat, cure or prevent any disease.

Information on the Services is for general education. It is not medical advice and does not replace advice from a qualified healthcare professional. Talk with your healthcare provider before using any dietary supplement, especially if you are pregnant or nursing, take medication, have a medical condition or are scheduled for surgery. Use our products only as directed on the label. If you experience a reaction, stop use and contact your healthcare provider and our Concierge team.

Joining our list is free and does not oblige you to buy anything. Early access, Elemental Membership and other pre-launch programs are offered at our discretion and may be limited in number or time.

The specific terms of any membership, including its price, how often you are billed, eligibility and how to cancel, will be shown to you before you enroll, and you will be asked to agree to them at that time. If those terms conflict with these Terms, the membership terms control for that membership.

Ordering is not yet open. Once it opens, all orders are subject to our acceptance and to availability. Prices are in U.S. dollars and may change before you place an order. We may limit quantities, or refuse or cancel an order, for example because of a pricing or description error, suspected fraud or a shipping restriction. If we cancel an order after charging you, we will refund the charge. We work to describe our products accurately; if we find an error, we may correct it.

Some memberships renew automatically. Before you enroll, we will clearly show the price, how often you will be charged and how to cancel, and we will ask for your express consent. We will then send you a confirmation of those terms. You can cancel online at any time before your next billing date, and cancelling will be at least as easy as signing up. Cancelling stops future charges.

Before ordering opens, we will publish our shipping, return and refund terms. They will apply to every order and will be available on this site and at checkout.

If you text our Concierge team at (877) 877-2660, or affirmatively agree to receive text messages during a call with us, you may receive text messages about your questions, membership, account, orders and deliveries. We do not send marketing or promotional text messages. Message frequency varies, and message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. Our SMS Terms are part of these Terms.

If you join our list, we will email you about Novuspan, our launch and our products. Every marketing email includes a one-click unsubscribe link.

You agree not to misuse the Services, including by breaking any law, interfering with the Services’ operation or security, accessing them through automated means without our permission, impersonating anyone or submitting false information.

The Services and their content, including text, graphics, logos, product names and designs, belong to Novuspan Labs LLC, its affiliates or its licensors and are protected by intellectual property laws. NOVUSPAN and our other marks are trademarks of Novuspan or its affiliates. You may view the Services for your personal, non-commercial use. You may not copy, modify, distribute or reuse their content without our written permission. If you send us ideas or feedback, we may use them without any obligation to you.

The Services are hosted by Shopify, and payments, shipping and messaging are handled by third-party providers whose own terms and privacy policies apply to their services. We are not responsible for third-party websites or services we link to.

To the fullest extent permitted by law, the Services and their content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted or error-free. Individual experiences with any dietary supplement vary. Nothing in these Terms limits a warranty or right that cannot be excluded under applicable law.

To the fullest extent permitted by law, Novuspan and its affiliates, members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from or relating to the Services or these Terms. Our total liability for any claim relating to the Services or these Terms will not exceed the greater of the amount you paid us in the twelve months before the claim arose or $100. Some jurisdictions do not allow these limitations, so they may not apply to you.

You agree to indemnify and hold harmless Novuspan and its affiliates from claims, losses and expenses arising from your misuse of the Services or your violation of these Terms.

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. If a dispute arises, please contact us first so we can try to resolve it informally. Any dispute that we cannot resolve informally will be decided by the state or federal courts located in Georgia, and you and we consent to their jurisdiction.

We may update these Terms. We will post the updated version on this page with a new “Last updated” date. Changes apply from that date and will not apply to orders placed before it. If you keep using the Services after a change, you accept the updated Terms.

These Terms, together with our Privacy Policy, SMS Terms and any membership terms you agree to, are the entire agreement between you and us about the Services. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a business transaction.
